1. APPLICABILITY OF AGREEMENTS
By using Our Services and/or by acknowledging that You have read these Agreements when You register to join and/or by clicking on the 'Submit' or 'I Agree' button when You install any of the software relating to the Services provided via the Platforms or when You register for Your Account, You agree to comply with these Agreements, and You acknowledge that Your failure to comply with these Agreements may result in disqualification, the closure of Your Account (hereafter as defined in Section 3 below), forfeiture of funds and/or legal action against You, as appropriate and as further specified in these Agreements. You acknowledge that if You accept these Agreements, the Casino will start providing You with the benefit of the Services immediately. As a consequence of this, if You accept these Agreements when registering for Our Services, You will not later be able to cancel Your registration, although You can terminate these Agreements and close Your Account in accordance with Section 20 below.

1.2 These Terms and Conditions (T&C) apply to the usage of Philgaming (“Casino”) through related enabling internet, mobile or other platforms by You (“You” or “Player”).

1.4 By using and/or visiting any section of the website Philgaming; or by opening an account on the website You agree to be bound by: Terms and Conditions; Privacy Policy; Responsible Gaming, FAQ, Any game rules; Bonus Terms and Conditions, special campaigns and tournaments ran on the website.
1.5 These T&C come into force as soon as You tick the “I accept the Terms and Conditions and Privacy Policy” button. By doing so You agree to be bound by these T&C and accept them.
1.6 The website ("Casino", "Website", “Company”, "We", "Us", "Our") is owned and operated by Philgaming, a company registered and established under the laws of Republic of Philippines. Remote gaming licensing and supervision is provided by Philippine Amusement and Gaming Corporation (PAGCOR).
2. LEGALITY OF USE OF THE SERVICES
2.1 The Casino reserves the right to unilaterally change these Terms and Conditions when such need occurs. We will do our best to notify our players of any significant changes by email. However, we do recommend all players to revisit this page regularly and check for possible changes.
2.2 Casino reserves the right to modify and/or amend this Agreement at any time with or without prior notice.
2.3 You fully understand and agree to be bound by the terms and conditions contained herein and as they may be amended by Us due to some changes in Casino.
2.4. You may only use the Services if You are 21 years of age or over and it is legal for You to do so according to the laws that apply in in the Philippines. We reserve the right to ask for proof of age from You and Your Account may be suspended until satisfactory proof of age is provided. You understand and accept that We are unable to provide You with any legal advice or assurances and that it is Your sole responsibility to ensure that at all times You comply with the laws that govern You and that You have the complete legal right to use the Services. Without limitation to the above, access to Our Services may be restricted from certain territories. Any use of the Services is at Your sole option, discretion and risk. By using the Services, You acknowledge that You do not find the Services to be offensive, objectionable, unfair, or indecent in any way.
3. WHO CAN PLAY/ACCOUNT/REGISTRATION
To use the Services, You will first need to register for an account with Us. You may access any of Our Services from Your Account (as defined below).
3.1 The Casino ONLY accepts players located in the Philippines.
3.2 The Casino accepts strictly adult players (the minimal age is 21).
3.3 If we are unable to confirm that You are of the Legal Age, we may suspend Your account. If You are proven to have been underage at the time You made any gambling or gaming transactions, Your account will be closed, all transactions or bets void. Any winnings, accrued during such time will be forfeited and You will return to us any funds, withdrawn from Your account.
3.4 It is entirely and solely Your responsibility to enquire and ensure that You do not breach laws applicable to You by participating in the games.
3.5 The Company reserves the right to ask for the proof of age from the player and limit access to the Website or suspend the Player Account to those players who fail to meet this requirement.
3.6. You can open an account with Us by choosing your mobile number and password and entering other information that We ask for on Our registration form such as (but not limited to) Your first and last name, address, email, gender, birth date and telephone number (an 'Account'). You shall ensure that the details provided at registration are accurate and kept up to date. You can change the details You provide at registration by contacting our 24/7 Chat support widget on the bottom right corner of our Philgaming website. 3.7. There are no set-up charges for opening Your Account. We are not a bank and funds are not insured by any government agency. All payments to and from Your Account must be paid in the currencies available on the Services from time to time, and payment fees are from the payment option you have used which is regulated by the Bangko Sentral ng Pilipinas rulings, and You shall ensure that all payments into Your Account are from a payment source for which You are the named account holder.
3.8. To play Real Money Games or place a bet, You will be required to pay 'real money' funds into Your Account by any of the methods specified from time to time by Us. Such funds will be deposited into Your Account upon actual receipt of funds by Us and/or our agents. Minimum and maximum limits may be applied to the payments into Your Account, depending upon Your history with Us, the method of deposit, and other factors as determined solely by Us..
3.9. You can request withdrawals from Your Account at any time provided all payments made have been received. We reserve the right to pay any requested withdrawal partly or in total via the same method of payment and in the same currency with which deposits were made. All withdrawal requests which are approved should be immediately credited to Your Account.
3.10. We are unable to guarantee the continued availability of any particular currency. In the unlikely event that it becomes necessary for Us to stop supporting a particular currency and Your Account Currency becomes unavailable, We reserve the right to require You to convert Your Account Currency into a preferred available alternative at the Exchange Rates offered by Us at the time of conversion.
4. TRUE IDENTITY AND ONE ACCOUNT
The name on Your Account must match Your true and legal name and identity and the name on Your Account registration must match the name on the payment accounts used to deposit or receive monies in Your Account. To verify Your identity, We reserve the right to request at any time satisfactory proof of identity (including but not limited to copies of a valid passport / identity card and/or any government issued identification card) and proof of address (including but not limited a recent utility bill or bank statement). Failure to supply such documentation may result in suspension of the Account. You are prohibited from holding more than one (1) Account in connection with Your use of the Philgaming. If You have more than one (1) Account or Accounts in different names, then You must contact Us immediately to have Your Accounts managed so that You only have one (1) Account. We reserve the right to close Your Account(s) if You open multiple Accounts. Should We have reasonable grounds to believe that multiple Accounts have been opened with the intention to defraud the company, We reserve the right to cancel any transaction related to said fraud attempt. If You have lost Your Account name or password, please contact Us for a replacement.
5. NO GROUP EMPLOYEES OR AFFILIATES
If You are an officer, director, employee, consultant or agent of Philgaming or one of its direct or indirect subsidiaries or a supplier or vendor of the Philgaming, You are not permitted to register for an Account with Us or to use directly or indirectly any of the Services (each an 'Unauthorized Person'), other than in the course of Your employment as a Group employee. Similarly, relatives of Unauthorized Persons are not permitted to register with Us or to use directly or indirectly any of the Services. For these purposes, the term 'relative' shall include (but not be limited to) any of a spouse, partner, parent, child or sibling.

(a) Public officials, which includes elective and appointive officials and employees, permanent or temporary, whether in the career or non-career service, whether or not they receive compensation, regardless of amount;
(b) Members of the Armed Forces of the Philippines, including the Army, Navy, Air Force or Philippine National Police
(c) Persons under 21 years of age or students of any school, college or university in the Philippines.
(d) PAGCOR officials and employees
(e) Gaming site Operators and employees
(f) Unregistered players
(g) Banned individuals
(h) Spouse, common-law partner, children, parents of officials and persons mentioned in items (a), (b), and (d) above.
6. YOUR USE OF THE SERVICES
6.1. We reserve the right to suspend, modify, remove and/or add to any of the Services in its sole discretion with immediate effect and without notice and We will not be liable for any such action.
6.2. We forbid the use of all unfair practices when using the Services. We do this to protect Our customers and the integrity of the Services. Please read Our Unfair Advantage Policy which is incorporated in this Agreement for further details and Our Anti-Cheating Policy at section 30.4. If any customer is found to be participating in any form of collusion or other activities that We consider to constitute cheating his or her account may be permanently closed and any balance may be at risk of forfeiture or withholding as per section 17 of these terms and conditions.
6.3 We forbid the posting of any prohibited Third-Party Content (as that term is hereinafter defined) on our Platforms. Please read our Third-Party Content Policy which is incorporated in the Agreements for further details.
6.4 We forbid players from posting in forums or websites any game/tournament codes/passwords for restricted and invitational events without sponsorship bond from Us.

DATA PROTECTION
We may share Your personal data with any of its agents who may only use such data for strictly the same purposes as We shall specify and within the terms of these Agreements. We shall use Your personal data in accordance with the Privacy Policy.
You should assume that all use of Our website, and emails, SMS and telephone calls between You and Us will be recorded. These recordings will be Our property and may be used as evidence in the event of any dispute or to improve customer services.
GOVERNING LAW
These Agreements shall be governed by and construed in accordance with the laws of the Philippines. You irrevocably agree to submit to the exclusive jurisdiction of the courts of the Philippines for settlement of any disputes or matters arising out of or concerning these Agreements or their enforceability. If any part of these Agreements is found to be invalid, illegal or unenforceable in any respect, it will not affect the validity of the remainder of the Agreements, which shall remain valid and enforceable according to their terms.
ASSIGNMENT
We reserve the right to transfer, assign, sublicense or pledge these Agreements, in whole or in part, to any person (but without Your consent) without notice, provided that any such assignment will be on the same terms or terms that are no less advantageous to You. You may not assign, sublicense or otherwise transfer in any manner whatsoever any of Your rights or obligations under these Agreements.
HIRD PARTY RIGHTS
Except insofar as these Agreements expressly provide that a third party may in their own right enforce a term of these Agreements, a person who is not a party to these Agreements has no right under national law or statute to rely upon or enforce any term of these Agreements but this does not affect any right or remedy of a third party which exists or is available other than under national law.
ENTIRE AGREEMENT, MODIFICATION AND AMENDMENTS
You fully understand and agree to be bound by these Agreements and as modified and/or amended by Us from time to time. We may amend these Agreements at any time either SMS messaging You notification of the new terms and/or by publishing the modified Agreement(s) on the relevant page of the Platforms or any place through which You access the Services. Any such modification will take effect within thirty (30) days of publication. If any modification is unacceptable to You, Your only recourse is to terminate these Agreements. Your continued use of the Services following notification or as the case may be such thirty (30) day period will be deemed binding acceptance of the modification. It is Your sole responsibility to review these Agreements and any amendments each time You play. These Agreements and the documents referred to herein represent the complete and final agreement between You and Us in relation to this agreement and supersede any and all prior agreements between You and Us.

GAMING SERVICES
The following terms apply only to Your use of the Gaming Services. Please note that in the event of any conflict between this Section 28 and the remaining Sections of these Terms and Conditions, the remaining Sections of these Terms and Conditions shall prevail.
Play Money and Real Money Games
By registering for the Gaming Services, You will be able to access (through our website (as defined below)) both 'play money' games and tournaments ('Play Money Games' or 'Play for Free Games' respectively) and 'real money' games and tournaments ('Real Money Games' or 'Play for Real Money Games' respectively), via the Gaming Services. No purchase is necessary or required to play the Play Money Games, save in respect to any cost You may incur to access the Gaming Services, charged by Your Internet service provider or telecommunications provider, and You may play the Play Money Games without betting money. We reserve the right to suspend, modify, remove and/or add any Gaming Service in its sole discretion with immediate effect and without notice and We will not be liable for any such action.
Rules and Procedures of the Gaming Services
You must use the Gaming Services in accordance with the generally accepted games rules set out in the Game Rules section of each game available in our website, including but not limited to the Promotions section.
Anti-Cheating Policy
Casino are committed to preventing the use of unfair practices in the Gaming Services, including but not limited to player collusion. We are also committed to detecting and preventing the use of software programs which are designed to enable artificial intelligence to play on Our Platforms including, but not limited to, opponent-profiling, cheating software or anything else that We deem enables You to have an unfair advantage over other players not using such programs or systems ('AI Software'). You acknowledge that The Casino will take measures to detect and prevent the use of such programs and AI Software using methods (including but not limited to reading the list of currently running programs on a player's computer) and You agree not to use any AI Software and/or any such programs.
Unfair Advantage Policy
Casino are committed to taking all reasonable measures, and to do so immediately to prevent anything that either diminishes the fun you have playing on the site, or that gives another player an unfair advantage over you when you play against them.
Unfair practices are any practice (including but not limited to the use of BOTs, AI, multiple account use and/or practices conducted in collaboration with other players) carried out by one or more players, with one or more accounts which could put any other player not engaging in such activity at a competitive disadvantage where the unfairness in such activity is due to its success being based to some extent on concealment and/or deception against such players. One way of thinking about this is to consider whether a group of peers, when presented with information about the practice, would overwhelmingly consider that practice to be unfair.
Examples of practices the Casino deem to be unfair (please note, this list is not exhaustive but simply illustrative of the types of practices the Casino will always consider unfair):
1. Multiple Accounts:
One person having multiple accounts, whether in the player’s name or another name, for the sole purpose of playing both accounts at the same time, whether at the same or different tables. In any event, it is not permitted to have more than account under our Terms and Conditions.
2. Collusion:
Two or more players sharing and using their combined knowledge to gain an advantage over other players at a table.
3. Rating Manipulation:
Players intentionally losing games on low stakes tables to keep their rank at a lower level than it would otherwise be.
4. The Use of "BOTS":
Certain companies offer for sale programs ("BOTS") specifically created to play a game in place of an actual (human) player, and conceal its use from the other players, and avoid detection by the online gaming site. These programs are marketed by explicitly promising the prospective purchaser-user an unfair advantage over other online players not using that program.
Do we forbid/discourage all online programs?
No, definitely not. Our own website provides programs for playing online. Our objective however, is in providing and promoting a level playing-field and the best possible user-experience for all of our Players.
How do you distinguish between Forbidden and Permitted categories of programs? Isn't it true that many of these programs are for training& e.g., improving gaming skills?
Programs that give a player an advantage over others are not something we wish to forbid. Advantage is not the issue& an unfair advantage is and we see that as deception. And so is invasion of privacy and data theft.
To begin with, our basis for distinction is not whether a particular program gives the user an advantage over non-using players, nor is it based on the particular content. To us, the key indicia that define the class of programs we seek to eliminate from use on the Site are: deception and breach of our customers' privacy.
Nevertheless, what our customers want will always remain the primary influence on what we do about this. So, for instance, we have no doubt that anything that compromises the integrity of the game or that erodes our customers' confidence about whether they will be unfairly disadvantaged while playing on our site, must be eliminated. And it's there that we direct our efforts. But our customers will always have the last word about what it is they want to play and against whom. So, if our customers want to play against BOTS, then we will seriously consider this request. But again, the bottom line is that we will do whatever it takes to ensure that our customers are not deceived and that their privacy is not violated.
Instead, what we're talking about here are programs which: (i) advertise as a key feature that the buyer/user will gain an unfair advantage (quite often they even use the word "cheat") over the other players in other words, they promise to help a player to cheat; or (ii) their use by the buyer/user is intended to remain concealed from the other players and from the "operator" (i.e., the online gaming room); or (iii) steal legally protected material (e.g., player identities) that violate International Copyright Laws as well as Privacy Laws.
Granted some of the companies who make programs that the Casino deem "forbidden" (i.e., that satisfies the criteria above) claim that the purpose of their programs is not to assist a player to cheat an online game but rather as a training aid (even though they might concede that an unscrupulous user could indeed use it for the purpose of cheating). Think for a moment about this claim. What other plausible reason is there to make and sell programs promised to give you an unfair advantage and at the same time remain concealed from the other players and the online room, and actually take the place of a player at the online table but in a way undetectable by anyone else. That aside, emphasizing one attribute to advertise their programs ("to cheat") but disavowing that attribute entirely in every other instance is dishonest, to say the least, and certainly does nothing to help the image of our industry.
So, if these companies who make such claims were honest, they would disable the functionality that allows use of the program to be concealed& since doing so would not compromise its claimed value.
What counter-measures are we talking to prevent the use of BOTS?
Our efforts can be divided into three separate categories: (i) identification & detection; (ii) warning/suspending offending users; and (iii) additional measures through enlarged customer choice.
Identification and detection counter-measures are in-place now and have been for some time. These efforts will continue to improve - so that we're able to more precisely detect existing BOTS, but more importantly so that as new BOTS are created/released, we can also prevent those from eroding the experience when on the website.
Do the efforts involve "data mining" or other intrusive means to access/read files on my computer as part of these efforts?
Yes, and indeed we want you to know that we do this and what particular data we're looking for and also why we need to. Perhaps the best way to explain this is by contract to the most well-known form of data mining i.e., what Google, Yahoo, AOL, and others like them are doing gathering data about the user for (among other reasons) purely commercial purposes (i.e., to sell a user profile to online advertisers). Now consider what we do. Our automated software reports on any processes or programs running on your computer that have been identified as prohibited software falling within our policy. We do not scan your hard drive or take screen shots from your machine. The very limited data that is provided to us is used only to query player's computers while they're playing at our tables, solely for the purpose of detecting use of the offending type of software we're talking about here. This type of monitoring remains one of the key counter-measures against the abuses caused by BOTS which we believe are against the interests of our players. Consequences of Unfair Practices:
Where we in our absolute discretion determines an unfair practice has taken place (whether an advantage has been gained or not) the person or persons responsible for that practice will face one or all of the following consequences:
• We may call the offender(s) and demand the immediate cessation of all unfair practices;
• We may suspend the offending account(s) for the purposes of conducting a thorough investigation into the unfair practices'
• Ultimately, we reserve the right, in our sole discretion, to terminate the offending account(s) indefinitely and for all funds in the account(s) to be forfeited (see section 6, 19, and 21 of our Terms and Conditions of Use)
Software
Philgaming platforms are used to provide the Gaming Services (the 'Software') online for your own personal use in using the Gaming Services in accordance with these Agreements, and further, that such access is made through web access online via computer or other device of which You are the primary user. The Software's structure, organization and code are the valuable trade secrets of the Philgaming and/or its associated companies and/or its licensors. You obtain no rights to the Software except to use it in accordance with these Agreements. Save as expressly permitted by law, You are strictly prohibited from, and agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software or any part of it or to create, publish or distribute derivative works from the Software. You agree that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by any applicable laws, restrictions or regulations.
